Terms of use
1. Provider and scope
These terms of use apply to the website alwisr.com and to the software Alwisr (together “Alwisr”). The provider is:

Hereinafter “we”. Conflicting terms of users apply only if we have expressly agreed to them in text form.
2. Status of the offering
Alwisr is in development and not generally available yet. The website provides information about Alwisr. Pages and functions marked as “planned” or “demo” show a planned workflow with invented example data; they connect no accounts, publish nothing and are not an offer to conclude a contract.
3. Businesses only
Alwisr is intended exclusively for entrepreneurs within the meaning of § 14 of the German Civil Code (BGB), legal entities under public law and special funds under public law. Anyone using Alwisr for a business confirms that they are authorised to do so.
4. Contract for the use of the software
Using the software requires a separate contract with us. It sets out the scope of services, the prices and the term. Where we process personal data on behalf of the business, we additionally conclude a data processing agreement under Art. 28 GDPR. If the contract conflicts with these terms of use, the contract prevails.
5. Access
Access credentials must be kept confidential and may only be used by the persons they are intended for. If there is reason to believe that unauthorised persons have gained access, the business must inform us without delay. The business is responsible for actions taken through its access, insofar as it is answerable for them.
6. Connected accounts with other providers
Accounts with other providers can be connected in Alwisr; a TikTok account, for example, is planned. Only a person authorised to use the account for the business may connect it. The connected account is additionally subject to the terms and policies of the respective provider; for TikTok in particular its Terms of Service, Community Guidelines, Branded Content Policy and Music Usage Confirmation.
Alwisr is not operated by TikTok or any other connected provider. Whether and to what extent a provider offers, changes or restricts its interface is outside our control. The connection can be removed at any time in Alwisr or revoked in the account settings with the provider.
7. Approval and responsibility for content
Alwisr publishes to a connected account only what an authorised person has expressly approved beforehand. The business is responsible for the content it prepares and approves. In particular, it must hold the necessary rights to videos, music, images and texts and label promotional content as such.
We do not review content in advance. However, we may block content and refuse to publish it if it is evidently unlawful or violates the provider’s policies.
8. Prohibited use
In particular, it is prohibited to use Alwisr to distribute unlawful content or unsolicited bulk messages, to access accounts without authorisation, to circumvent security measures or usage limits of Alwisr or a connected provider, and to attack or overload our systems.
9. Availability and further development
We continue to develop Alwisr and may change functions where this is reasonable for the business. We owe a particular level of availability only if the contract commits to it. We provide the website and the demo without any guarantee of constant availability.
10. Liability
We are liable without limitation for intent and gross negligence, for injury to life, body or health, under the German Product Liability Act and where we have given a guarantee. In cases of slight negligence we are liable only for the breach of material contractual obligations, meaning obligations whose fulfilment makes the proper performance of the contract possible in the first place and on whose fulfilment the business may regularly rely; in this case liability is limited to the foreseeable damage typical for the contract. Otherwise, liability is excluded.
11. End of use
How the contract for the software ends is set out in the contract. If a connected account is disconnected or the contract ends, we delete the access tokens of the connected account. What happens to other data is described in the privacy policy and the data processing agreement.
12. Privacy
How we process personal data is described in our privacy policy on this website.
13. Changes to these terms of use
We update these terms of use when Alwisr or the law changes. Changes apply to existing contracts only if the business agrees or the contract provides a procedure for this. We announce changes in text form before they take effect.
14. Governing law and place of jurisdiction
The law of the Federal Republic of Germany applies, excluding the UN Convention on Contracts for the International Sale of Goods. The exclusive place of jurisdiction for all disputes is Berlin, insofar as the user is a merchant, a legal entity under public law or a special fund under public law. In case of doubt, the German version applies.
